But, alas! The history again got repeated. According to the master plan of monarchy and its foreign abettors, they made such an environment in which election could not be held by spreading massacre, terror and anarchy in madhesh and other parts of the country. Therefore, CPN (Maoist) once again put forward and took stand for the demand of constituent assembly that can only be held after the abolition of monarchy and establishing republic and our party wrote the 'note of decent' regarding the postponement of the election to November 22, 2007. In the insistence of CPN (Maoist) only there was the second amendment of the constitution for abolishing the monarchy by the two third majority of the interim legislature. But, events after that are proving that the situation of anarchy, massacre and terror still exists as the pre Jestha (June 14th) scenario in Madesh and other places. Even after this monarchy and retrogressive elements are still active. In order to disrupt the constituent assembly election armed gangs are mushrooming every passing day. In this situation, there would be no greater lie, hypocrisy and insincerity than to say that constituent assembly election can be held by keeping the monarchy in place. Right now, the monarchy is the main obstacle to hold the election. Therefore, the environment for the constituent assembly election can be created only by completely abolishing monarchy from interim legislature and for this it is an inevitable necessity of today to carry on the struggle from all the fronts, the government, legislature and the street. n addition to the conspiracy by national and international reactionary forces against the constituent assembly election objectively another important adverse reason for the conducive environment for constituent assembly election is the lack of guarantee of proportional representation of different oppressed indigenous - tribal, madeshi, women and oppressed caste people. During the peace process CPN (Maoist) had fought for the restructuring of the state in federal form, and proportional representation but especially due to the insistence of Nepali Congress and also due to the fear of the obstruction of the whole peace process we were compelled to be flexible for the agreement. However, the series of incidence after that and especially the incident of Madesh have conformed that without ensuring the proportional representation of all oppressed class, nationality, region, sex the constituent assembly election is not possible to be held and should not even be held. Because constituent assembly election is not a periodical parliamentary election but it is a body that makes the main law of the land for long term and if there can't be the proportional representation of different sects of people in it, there is the possibility of emergence of conflict of serious nature. In this situation, by organizing a comprehensive round table conference of the representatives of all the agitating Madeshi, indigenous-tribal, oppressed, women, the civil society and the political parties etc a common consensus should be built up which is the another important basis to ensure the election of the constituent assembly. In stead of doing this, to go on taking initiative to negotiate with all the daily mushrooming outfits and wasting time and energy really means in substance only to endanger the constituent assembly election it self. Another important reason for not having conducive environment for the constituent assembly election in the country is because all the provisions in the Comprehensive Peace Accord are not firmly and promptly implemented and no work was done to create the feeling of change in the life of people even after the 10 years of people's war and 19 days of historical mass movement. Especially not providing any relief to the martyrs of the people's war and the mass movement, not having proper treatment to the wounded, not finding out the real situation of the disappeared, not managing the Peoples' Liberation Army properly, not taking initiative to implement the fundamental rights of the people in education, health, employment, right for food according to the provision of the interim constitution, instead of running the interim government through consensus, running it like one party or multiparty system of the past etc, the situation is increasingly becoming repulsive rather than attractive for the people to go on for the election of constituent assembly. Apart from that different international reactionary forces are spreading unwanted activities and interference by taking advantage of this transitional period which has created a great danger for the national sovereignty and glory. In
the whole the country is facing a great crisis. If the existing wide spread
situation of obstacle, confusion, doubt, anarchy is not confronted by the
forward moving way then according to the historical law there is a great
danger of the country again returning to regression and in a fierce conflict.
If the country again returns to conflict that will be dreadfully fatal,
destructive and might create the risk for the existence of the nation.
So, all true patriotic, democratic, republican and leftist forces who favour
peace, democracy, progression, it has become a necessity to carry on the
struggle to create minimum atmosphere for the sake of ensuring the election
of the constituent assembly and making the peace long lasting.
The 22-point prerequisite to ensure the election of the Constituent Assembly 1. The monarchy and monarchist elements have launched organized destructions and violence in different parts of the country conspiringly not to let the constituent assembly election to be held. So the abolition of the monarchy and the establishment of the republic should be immediately declared from the interim parliament. Prior to the declaration the parties including the Nepali Congress who have not yet formally decided anything about the republic must publicly clarify their position on monarchy. 2. As greed upon in the Comprehensive Peace Accord (CPA) the property of the late King Birendra and his family and the whole property possessed by King Gynandra in the capacity of being the king must be nationalized for which an effective step must be taken and there should be speedy implementation. 3. The Nepal Army kept at Narayanhiti palace until now for its security must immediately be taken away and a simple type of security arrangement has to be made to Gynendra and his family. 4.
All the guilty persons indicated by Rayamajhi Commission must be persecuted
as sternly as possible at the earliest even by promulgating retrospective
law.

A comprehensive round table conference has to be immediately organized
to ensure the proportional representation of all classes, nationalities,
regions, Madhesis, women, Dalit and all minority communities in the constituent
assembly election.
8. The local body has to be formed on the basis of agreement in order to ease and simplify the election of the constituent assembly election, to ensure the involvement of the mass of the people to the grass root level and to accelerate the developmental works. 9.
The appointments of the ambassadors to different countries, university
executives, Human Rights Commission, the chief commissioner of Commission
for the investigation of the abuse of authority (CIAA) and its commissioners
and the organization of the high level monitoring commission must be done
by consensus.
11. In course of the people's war, the hostages confined in the jail cells on Nepal and India on false allegations must all be released together and all cases filed against the Maoist leaders and cadres must be cancelled. 12. The families of all martyrs, who sacrificed their lives in course of the people's war, must immediately be supported as an immediate relief of at least hundred thousand rupees per person. All injured persons in course of the people's war and people's movement must get all treatment from the government. 13. A high level probe committee must immediately be formed for finding out the facts of all disappeared during the people's war and for the recommendation of the legal action against those who are found guilty through the investigation. 14. An effective and special initiation must be taken on the government level for the correction of weakness and serious carelessness in the proper management of the cantonments of the People's Liberation Army (PLA). 15. The decision of interim government about providing monthly three thousand rupees per person for the members of the PLA has not yet been implemented and thus it must be executed without any delay. 16. Education, health, employment and food sovereignty have been accepted as the fundamental rights of all people in the Comprehensive Peace Accord and in the interim constitution, so a legal and executive step must proceed for its practical application. 17. A high level land reform commission must immediately be formed in order to execute provisions of the comprehensive Peace Accord regarding for the "execution of scientific land reform program by appropriating the feudal land ownership. 18. The persons who made the unlimited earning of property through corruption by holding government post for personal benefit must be rigorously persecuted, based on the provision of the Comprehensive Peace Accord, for which the present constitutional and governmental sectors have proved to be quite incapable and incompetent, so a special body must be formed in order to proceed the actions against the corrupt ones. 19. A high level commission for the advanced restructuring of the state must be formed in order to proceed forward towards the federal structure of the nation with the rights of self-determination and the power of autonomy to the nationalities and regions. 20. The unwanted move of internal destructionist activities, inferences in the internal affairs by the various foreign reactionary powers within the country, must be stopped with rigorous actions and any treaties, negotiations and understandings of long term importance, including the water resources must not be done until the constituent assembly election is held. National independence, sovereignty and geographical integrity must be fully safeguarded. 21. The genuine demands of the peasants, laborers, students, public servants, dalits, women, indigenous tribes, nationalities, Madhesis, industrialists and businessmen and media workers and various other classes and masses who are in the movements must be fulfilled, and a conducive environment should be created for the involvement of all in the constituent assembly election. 22. The Comprehensive Peace Accord that is held between the Communist Party of Nepal (Maoist) and the government of Nepal must be fully implemented in practice immediately. (Prachanda)
